Is a realestate contract binding or void if the lender does not sign the borrowers copys?

Posted by admin on July 22nd, 2011 and filed under homes realestate | 2 Comments »

I helped my daughter purchace her first home. After one year she was unable to continue making her mortgage payments. We tried to get a loan modification but was denied. I reviewed the contract and noticed that the lender did not sign any of the documents.

The contract of sale would be signed by buyer and seller- not by mortgage company. Even if some of the contract paperwork is not binding for some reason- the fact that your daughter signed the closing documents shows that she was OK with what had been agreed.

If you are talking about loan documents that she got at closing- she may have gotten copies that were not yet signed by mortgage company at closing. She could have gotten copies later that had signatures- or the signed ones may have been sent directly to county. It is possible someone made a bad mistake- but not very likely. You would have to hire a good local real estate lawyer to get a good idea.

with forclosures increasing and home values decreasing, can a home owner appeal to reduce his realestate taxes?

Posted by admin on October 8th, 2010 and filed under homes realestate | 3 Comments »

You can request that your assessment be reduced. The tax rate will stay the same, regardless of the amount you are assessed for, so you may be able to get a lower tax bill if you can get the assessment lowered.
However, you will have to research assessment records to show that your current assessment is higher than that for comparable properties in order to get it reduced.
You will find this difficult to do. You may find a Realtor who would do it for a modest fee.
The fact that home values are declining will show up in everyones assessment in future years. However for any given year, you would have to show that your assessment is higher than assessments for comparable properties in order to get yours reduced.

bought a home which realestate agent and all papers state as placed in 1996?

Posted by admin on October 5th, 2010 and filed under homes realestate | 1 Comment »

we were told it was stick built, today at the assessors office we find out its been placed in 1992, placed? we were told it was stick built? what can we do, its not energy efficennt like we believed a home in 1996 would be, we have done aton of work to this property, what can we expect? called attorney, is he good?

Did you get an appraisal and a building inspection? If you did, they would have easily discovered it.

If you didn’t, then that’s your fault.

Contracts don’t require that type of disclosure if the house was moved from another location.

Technically, it WAS stick built…just not where it is now.

I am a realestate broker in Illinois and want to hang my license at home and go inactive. Can I do this?

Posted by admin on June 30th, 2010 and filed under homes realestate | 2 Comments »

Can I do this and refer people out to other brokers and be paid a referral fee?

You need to contact the local Board of Realtors and/or the Real Estate Commissioner to let them know you want to be inactive. They may take your license and give you a copy for your files at home and put the original in your file at their office. This insures you are not practicing and keeps them up to date. If you don’t let them know and just take it home you could lose your realtor and broker licenses.

If you want to be paid a referral fee, you must have the agent you do business with state that you are a inactive broker so that the referral fee is legitimate. It will come back to haunt you and the agents you want to get paid from if you don’t.

What should a good realestate agent do for me?

Posted by admin on June 28th, 2010 and filed under homes realestate | 2 Comments »

Im buying a new home and I think my realtor is not doing a good job. What should a good realtor be willing and ready to do for a client?

Figure out what you want, and do the research

1. send you a daily list by email of properties that could be in the ball park of the properties you may like, then wait for your feedback.

a. location ok?
b. type of home ok?
c. prices in your range?
d. you need pre approved mortgage?
e. warn you of anything going on in the market
f. tell you of new developments
